Terms & Conditions
1. General Definitions Company, “Seller”, "we" or "us" refers to Ready Made Kitchen (RMK), a division of SCI Ltd, a limited company, registered in England (Company Number: 3914489) whose registered office is at 76 Bridge Street, Belper, Derbyshire, DE56 1AZ. Customer, “Purchaser” or "you" refers to the person, company or other organisation buying Products from the Company. Contract refers to the agreement between the Company and the Customer for the purchase of the Products and incorporating these terms and conditions. Order refers to the confirmed purchase of Products that the Customer has agreed to and has paid for in accordance with the Company's payment terms. Products refer to the goods sold by the Company. Website refers to this website. These Terms and Conditions do not affect your statutory rights in any way. This agreement is governed by English Law and any dispute will be dealt with exclusively in English Courts 2. Use of the Website You may use the Website only for lawful purposes and in a manner that does not restrict the use of the Website by other users. You agree not to do or cause to be done anything which might interfere with the proper working of the Website. You agree not to copy or modify any part of the Website without our prior written permission. You shall indemnify us in respect of all costs (including legal costs on a full indemnity basis), losses expenses and claims in respect of or in connection with: any improper use by you of the Website; any breach by you of any of these Terms and Conditions or any relevant legislation or regulations; any claim brought against us as a result of or in connection with your actions or omissions. You acknowledge that you are responsible for inputting the correct information requested of you. We reserve the right to change or remove content on the Website at our discretion without prior notice and without there being any liability on our part. We may have to suspend the Website from time to time to carry out maintenance and to make upgrades, which may result in you being unable to access the Website or part of it. We try our upmost to ensure the accuracy of all content on our Website, however we cannot guarantee it is completely error-free and we cannot be held responsible for potential typographical errors, colour accuracy, image discrepancies or product dimensions - any errors that may occur are wholly unintentional and we apologise for any inconvenience which this might cause.
3. Design The prices on our Website include our free design service. We will show you a design of your kitchen which is our interpretation of your requirements and we will request your approval - this must be checked thoroughly by you. You must notify us of any discrepancy in the design at this point as we will not accept any liability of any post-completion errors or omissions. No production will take place until we have received in writing your "signed off" approval that the proposed design meets your requirements and that you are happy with all details / items included in your Order. Placing an Order Online is considered as a submission of a "signed off" approval of the Purchaser's design and Order. The Company cannot be held responsible for any consequences of changes made to the design on site after the delivery of your Kitchen Order. If you provide your own design for us to use you hold the responsibility about it and warrant that you are entitled to use that design and either own the copyright or are entitled to use it and will indemnify us against all claims made by third parties. If you have asked us to design your kitchen for you, we retain the copyright in such designs unless we agree in writing that you have acquired its ownership. We may publish your kitchen design on our Website with a unique reference number unless otherwise instructed in writing.
4. Delivery Delivery is free of charge to UK Mainland addresses for most Orders. Delivery is to the ground floor. Adequate access to the delivery area must be ensured by the Purchaser. To qualify for free delivery a minimum order value of £1500.00 including VAT applies for kitchen furniture only, unless adding items to an existing Order, which has not yet been delivered and the delivery of the additional Products can be arranged at the same time, subject to a confirmation from the Company. Kitchen furniture Orders of value less than £1500.00 will incur a set delivery charge of £200.00. If the Order consists of kicthen appliances only, there will be a delivery charge depending on the weight of the Products which will be clearly stated in the formal quotation. Kitchen furniture Orders are delivered directly from the factory in Germany to the Purchaser's property. They are loaded on large vehicles - the Purchaser must ensure adequate access is provided. At the time of delivery, the driver will require help offloading. Delivery times commence at the date of receipt in writing of a "signed off" approval of the kitchen design that we supplied to the Purchaser and a payment for the Order in full. Delivery dates will be confirmed at order placement. Any delivery day or lead-time specified is a best estimate only and shall not be binding upon us. A Company's delay in delivery of the Order (or part of it) does not entitle the Purchaser to terminate the Contract or to request a compensation of any form. All delivered Products must be checked thoroughly for damage and delivery notes signed accordingly. Please refer to Clause 13. Failed deliveries will incur an additional delivery charge if the Purchaser is not present at the agreed delivery date.
5. Prices All prices quoted on our Website are in pounds sterling (GBP). All prices include VAT at the current rate unless otherwise stated. The displayed prices on the Website are guide prices only subject to viewing a confirmed design. Once full design specifications have been finalised, a quotation price will be confirmed. All prices are subject to change without notice. All confirmed quotations remain valid for 30 days from the day of quoting unless otherwise stated by the Company, error and omissions excluded. Quotes published online are only valid for the unique Purchaser they've been issued to. Quotations published online are for kitchen cabinets only and do not include electric appliances, sinks or work surfaces unless stated otherwise - the design images may show complete kitchens for better aesthetic performance and to help the Purchaser to get an idea of what the finished kitchen would look like, however the quotations are for the kitchen cabinets only, unless stated otherwise. We reserve the right to adjust the prices quoted on Orders to take account of additional costs to us including but not limited to additional costs caused by changes in the law and/or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties, currency fluctuations or otherwise.
6. Payment Terms We require a payment in full before we can commence work on Orders placed by Purchasers. We accept payments by Debit/Credit cards online or over the phone. We also offer Buy Now Pay Later financing schemes in partnership with Way2Pay (www.way2pay.co.uk). Should a Purchaser take advantage of a Buy Now Pay Later scheme, this must be confirmed in writing by us and our partner Way2Pay and we will then treat such Customer’s Orders as paid for. All products remain the property of the Company until paid for in full.
7. Products We reserve the right to change without notice minor details or design of Products which do not materially change their character or value. We believe we have accurately described all Products on the Company's website and we make every effort to prepare your kitchen design as accurately as possible, however, all illustrations are approximate only and are intended to give a general idea of the Products. All descriptions of the Products on the Website are a brief guide only. Therefore, if there is a particular aspect of the description of the Products on which you intend to rely, you must advise us of that in writing before we prepare and send you an Order confirmation, so we can confirm it with the manufacturer before processing the Order.
8. Samples Samples are sent in packages of up to three at a cost of £15.00 per package. There is no limit to the number of the sample packages a Customer may purchase. The Company will refund the cost of Samples of value up to £30.00 per Customer when an Oorder for a kitchen is placed with us. For this purpose, each Customer who has purchased samples will be issued with a Sample Voucher. Use of Sample Vouchers - sample vouchers can only be used Online at the time of Order placement - simply insert your code in the view basket screen in the "enter code" box and click the "apply changes" button. This will automatically reduce the cost of your kitchen Order by the value of your sample voucher. The Company will not credit back any sample costs to Purchasers who failed to use their sample vouchers on Order placement.
9. Availability All Products are subject to availablility. The Company will endeavour to deliver goods within the specified times, however in cases of unavailability or unforseen circumstances there could be delays beyond our control for wich we cannot take responsibility. If a requested Product is unavailable we will offer an alternative Product whenever possible.
10. Installation Installation service is not included in the stated prices of the products and the Company does not provide this service as standard. Fitting Instructions are available under the Help Tab from the menu on the left and an instruction leaflet is supplied by the factory with the delivery of the cabinets. If the installation service is not provided by the Company, RMK cannot be held responsible for fitting errors / amendments. Installation service is available for specific UK locations at an additional charge. The Purchaser can obtain updated information regarding installation coverage zones and charges from the Company's sales advisors.
11. Guarantee All Products are covered by a minimum of 5 year manufacturer’s guarantee, provided the Products are installed and used in accordance with the manufacturer’s instructions. The Products we supply are intended for domestic use and not for commercial use unless otherwise stated in the product description or approved by the Company in writing. Products used outside the
12. Order Changes, Cancellations and Returns You must notify us of your intention to change or cancel your Order within 7 days from the date of the Order confirmation. We will make every effort, upon receipt of your request in writing, to change or cancel your Order. We are unable to cancel or change your order after the 7-day period due to our Products being bespoke and manufactured to order. Within the 7 days, if production of your Order has not yet started, no additional charges will be applied. If production of your Order has started, there will be additional charges to change or cancel your Order. The charge will be based on work carried out up to the date of notification and the cost of materials no longer usable elsewhere. Any increase in the Order quantity will need to be regarded as a separate contract, potentially with a separate delivery date, unless written notification is received before work has commenced. The Company does not accept returns of Products that have been delivered or / and Order cancellations / changes have not agreed in writing.
13. Passing of Risk On delivery of the Products, the risk is automatically passed onto the Purchaser. The Purchaser must insure the Products against loss and damage by fire or other insurable risk from that time until the ownership of the Products passes to the Purchaser.
14. Claims Any claims related to the Products or their delivery must be made in writing to us, so as to reach us within 2 days of the date of delivery or such Products shall be considered to comply with the quality and quantity standards outlined in the terms of the Contract. All Products must be examined at the time of delivery in the presence of the delivery driver and any discrepancies found must be noted on the delivery note. As set out in Clause 15, we shall not be liable for any loss arising from damage caused to the Products in transit unless the loss or damage is reported on the delivery note at the time of delivery and subsequently reported to us in writing in accordance with this Clause. The Company will not be liable for any costs, direct or indirect, incurred by the Purchaser as a result of damaged goods or shortages that have not been reported as set out in this Clause. Products are only returnable with our prior written agreement.

Where a valid claim is made, we shall have the right to replace the Products and the Company shall then have no further liability to the Purchaser in respect of that claim. The liability of the Company shall never exceed the price actually paid for the Products by the Purchaser.
16. Unexpected events We will not be responsible for failure and/or delay in the carrying out of our obligations under the Contract arising out of any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any cause and in such circumstances we shall be entitled by written notice to the Purchaser to terminate the Contract in whole or in part without incurring any liability whatsoever to you.
17. Assignment The Purchaser may not assign, sub-contract or in any way transfer or dispose any of its rights or obligations under the Contract without the prior written consent of the Company.
